Casa, Inc. (“Casa,” “we,” or “us”) is committed to providing a pleasant website experience. This website, or any replacement site (collectively the “Site”), is operated by Casa, Inc. to provide you with general educational information and to help users learn about and access a variety of health care services. Casa provides you with access to the Site subject to the following Terms of Use (“Terms”). We may revise these Terms at any time by posting an updated version to the Site. You should visit the Site periodically to review the most current Terms.

These Terms constitute a binding agreement between you and Casa, and are deemed accepted by you each time that you use or access the Site. If you do not accept the Terms set forth here, you should not use the Site. Users who violate these Terms may have their access and use of the Site suspended or terminated, at Casa’s discretion.

The public areas of the Site are accessible to all users, regardless of age. However, areas of the Site that involve the collection or provision of personally-identifiable information, such as the areas of the Site that allow you to contact us, connect with us, sign up for our mailing list, and donate, are restricted to users 13 years of age or older. If under the age of 18, or the age of majority as it is defined where you live, you must use the Site under the supervision of a parent, legal guardian, or other responsible adult.

Site Content and Information

You are not authorized to reproduce, republish, distribute, transmit, modify, sell or otherwise use the Content, or to create derivative works based on the Content, in whole or in part, without Casa’s express written authorization or as expressly provided by these Terms. Without limiting the foregoing, you are not authorized to use the Content in order to gain a competitive advantage, for marketing purposes (including third-party solicitations), to harass, abuse or harm others, or in a way that otherwise exceeds the scope of your authorized access to the Site. In addition, you are not authorized to use, access, search, or obtain data from the Content of the Site by using any deep-link, framing, page scrape, robot, spider or other automatic device, program, algorithm or similar methodology. Any code used to generate or display any Content, or the pages making up the Site, is also protected by Casa's copyright and you may not copy or adapt such code.

Limited Permission to Provide a Link to Our Website from Other Websites

Without limiting the provisions of the foregoing section, you may include a link to the Site from your website provided that the link complies with all of the following requirements:

The link must state that it leads to the website of “Casa”; and

The link and the linking website must not falsely represent or suggest any relationship between the linking website or the linking sponsor’s products and Casa (including, without limitation, suggestions of affiliation or endorsement), unless such a relationship exists and the statement describing the relationship has been expressly approved in advance by Casa.

We reserve the right to revoke the ability to link to our Site at any time and for any reason.  If we revoke this ability, you agree to immediately remove all links and references to this Site.

The Site may provide links to third-party websites that are not owned or controlled by Casa. Casa has no control over, and assumes no responsibility for the content and/or activities of these sites. Site visitors are encouraged to be aware when they leave the Site and to read the terms and conditions and/or privacy statements of any website that they visit.

Digital Millennium Copyright Act Notice

Casa respects the intellectual property rights of others. We reserve the right, in appropriate circumstances and within our sole discretion, to terminate the access of visitors or clients who infringe the copyright or intellectual property rights of Casa or others through use of or access to the Site. If you believe that your work has been copied and is accessible at this Site in a way that constitutes copyright infringement, or that this Site contains links or other references to another online location that contains material or activity that infringes your copyright rights, you may notify us by providing us (at the address set forth herein) with the information required by the U.S. Online Copyright Infringement Liability Limitation Act of the U.S. Digital Millennium Copyright Act (the “Digital Millennium Copyright Act”), 17 U.S.C. § 512, et seq.

Conduct

You agree that you are prohibited from using the Site to commit fraudulent activities, violate any law, statute, ordinance or regulation. Furthermore, no communications passing through the Site may be defamatory, libelous, unlawfully threatening or unlawfully harassing, obscene or contain any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. You may not reverse look-up, trace, or seek to trace any information on any other visitor to the Site or Casa client. You agree not to use any device or routine to interfere or attempt to interfere with the proper working of, or any other person’s use of, the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Casa’s systems or networks, or any connected systems or networks. Casa will take immediate action to prevent violators of this policy from using the Site.

Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, CASA DOES NOT WARRANT THAT THE SITE WILL OPERATE ERROR-FREE OR THAT THE SITE AND ITS SERVERS ARE FREE OF COMPUTER VIRUSES OR OTHER HARMFUL MECHANISMS. IF YOUR USE OF THE SITE OR THE CONTENT RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA OR ANY OTHER COSTS, CASA IS NOT RESPONSIBLE FOR THOSE COSTS. Disclaimer of Consequential Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CASA, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON ANY CASA SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE SITE AND/OR ITS CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT CASA IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CASA'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED $50. THESE LIMITATIONS WILL APPLY EVEN IF THE REMEDIES FAIL OF THEIR ESSENTIAL PURPOSE.

Indemnity

You agree to defend, indemnify, and hold harmless Casa, its affiliates, and their respective officers, directors, employees, counsels, and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from (i) your use of the Site and any of its contents or (ii) your breach of these Terms. Casa shall provide notice to you promptly of any such claim, suit, or proceeding.

Miscellaneous

Casa makes no claims or representations that the Site and/or Content may be lawfully viewed or accessed outside of the United States. Access to the Site and/or Content may not be legal by certain persons or in certain countries. If you access the Site and/or the Content you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

These Terms are governed by the internal substantive laws of the State of Maine, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Cumberland County, Maine. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, Casa’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect Casa’s ability to enforce such term at any point in the future. Except as expressly provided in an additional agreement or additional Terms for certain areas of the Site, these Terms constitute the entire agreement between you and Casa with respect to the use of the Site. No changes to these Terms shall be made except by a revised posting on this page.

Term and Termination

These Terms will remain in full force and effect while you are a user of the Site. Casa reserves the right, at its sole discretion, to pursue all of its legal remedies, including but not limited to immediate termination of your registration with or ability to access the Site and/or any other services provided to you by Casa, upon any breach by you of these Terms or if Casa is unable to verify or authenticate any information you submit to the Site registration. Even after you are no longer a user of the Site, certain provisions of these Terms will remain in effect, including the sections related to site content, disclaimer of warranties, disclaimer of damages, limitation of liability, and indemnity, inclusive.
